This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Ex Nihilo Labs LLC (“Licensor,” “we,” “our,” or “us”) for the use of Klatch App (the “App”), which is licensed, not sold, to you through the Apple App Store.
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.1. Scope of License
This license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the App Store Terms of Service. This license does not allow you to use the App on any device that you do not own or control.2. Restrictions
You agree not to:
* Decompile, reverse engineer, disassemble, attempt to derive the source code, or modify the App;
* Reproduce, distribute, sublicense, or create derivative works of the App;
* Use the App for any unlawful, harmful, or abusive purpose.3. Ownership
The App and all related intellectual property rights are owned by Ex Nihilo Labs or its licensors. All rights not expressly granted to you are reserved by us.4. Privacy

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EX NIHILO LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.9. Third-Party Terms
The App may use third-party services or open-source software. Your use of such features may be subject to additional terms and conditions from those third parties.10. Apple Requirements
This Agreement is between you and Ex Nihilo Labs LLC, not Apple. Ex Nihilo Labs LLC is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligations.11.
